Court in Spain tells FIFA, UEFA not to stop ESL plans, in preliminary ruling

A Spanish court has said within a preliminary ruling that FIFA and UEFA should not prevent European football clubs from taking part in the European Super League

The court has said in the written ruling that both FIFA, UEFA and all of its associated football federations should not adopt “any measure that prohibits, restricts, limits or conditions in any way” the formation of the European Super League.

The new tournament has been criticised as a closed competition that will destroy clubs at all levels, but its chairman disagrees.

The ruling came from a commercial Spanish court that adjudicates legal corporate disputes, and its jurisdiction within the case was not made immediately clear.

This comes after twelve of the leading football clubs in Europe have agreed upon establishing a new Super League, despite the widespread criticism of these plans. The new league has already been criticised by politicians, former players, and other football bodies.

The Premier League has said that it is considering “all actions” in order to prevent the plans for the league from “progressing”, while the UK government has so far failed to rule out stopping players from the clubs involved from acquiring work visas or withdrawing any police funding for the match days.

The Competition regulator the Competition and Markets Authority (CMA) has also said that it is “carefully considering” the new ESL proposals.

It comes after the chairman for the new league has defended its formation following major backlash from many, claiming that those who are involved are starting the league in order to “save football”.

Florentino Perez, who is also president of the Real Madrid football team, told El Chiringuito TV: “We’re doing this to save football, which is in a critical moment.

“The important clubs in England, Italy, and Spain must find a solution to a very bad situation that football is going through.

“The only way of making money from admissions is by making more competitive games that are more attractive, that fans around the world can see.”

Arsenal, Chelsea, AC Milan, Liverpool, Manchester City, Manchester United, Tottenham Hotspur, Atletico Madrid, Barcelona, Inter Milan, Juventus, Real Madrid and have all joined the European Super League as its founding clubs, securing vast financial rewards for themselves in doing so, at a time when takings have been hit by restrictions from the COVID-19 Pandemic.

This comes after Rebecca Welch has become the first ever female referee to be appointed to officiate a game within the English Football League, it has now been announced. Welch, who is 37 years old, will be presiding over the League Two clash between the teams Harrogate Town and Port Vale that took place on Monday.

But they have been largely criticised by fans, politicians and former footballers, many of whom have called these teams greedy and warned that the new competition will damage the game of football.

In a pre-match news conference the manager of Manchester City, Pep Guardiola, admitted that he feels uncomfortable when being asked about the new league because he does not yet know much more than the initial statement.

Guardiola said: “It is a little uncomfortable for us. We don’t have all the information. Once we have all the information, I will give my opinion.
He said he would like the president of the proposed league to tell the world why they think it is a good idea.

“I support my club, I know my people. I am part of this club but also have my own opinion. And I would love to be clear when I have all of the information,” he said.
